Terms and Conditions - Timeless Timelines UK

General Service Agreement

In this General Service Agreement (the “Agreement”), the Client is the purchaser of Genealogical Services provided by the “Genealogist” of Timeless Timelines UK. The “Genealogist” of Timeless Timelines UK is Glen Mahoney, 73 Monmouth Drive, Castle Park, Merthyr Tydfil, Glamorgan, Wales, CF48 1JB.

Background

The Client is of the opinion that the Genealogist has the necessary experience and abilities to provide the relevant genealogical Services.

The Genealogist is agreeable to provide such Services to the Client based on the Terms and Conditions as set out in this Agreement.

​

Services Provided

The Client hereby agrees to engage the Genealogist in the type of Service chosen by the Client and set out by the Terms and Conditions in this Agreement. The Services will also include any other tasks that the parties may agree on.   The Genealogist hereby agrees to provide such Services to the Client.

Information Provided by Client to the Genealogist Prior to Research

The Genealogist will require sufficient information from the Client before a project commences. This will help to correctly identify the Client’s ancestors to start the Research. For the Standard Research Packages, this will normally

include the exact or approximate birth, marriage and death dates and locations of the Client’s ancestors going back to the first half of the 1900s.

Initial Free Assessment

Based on the information provided by the Client, the Genealogist will offer an initial free assessment of the potential viability of the requested Research and provide a free quote for the type of Research requested by the Client.

​

Services to the Client

In line with the objectives of the Research agreed by the Client, the Genealogist will provide the Client with:

  • A Research Report – including findings, records searched (primary/secondary), and analysis of the information.

  • An updated pedigree chart or other charts as appropriate.

  • Copies of relevant certificates (births, marriages, and deaths).

  • Transcripts of Census records.

  • Transcripts of Parish records.

  • Copies of any other relevant documents  (in line with copyright and licensing agreements)

  • An overview of successful and unsuccessful searches of documents.

  • An evaluation of evidence, sources and information related to any family links, and details and identification of ancestors.

  • Recommendations for further research.

Time Taken for Services

Before Research commences, the Genealogist will inform the Client as to the likely arrival time of completion of Services to the Client.  Typically, this will be within 30 days for a Single Line Research Package from the beginning of Research, which takes into account the time normally required to access the relevant documents from various organisations.  The Genealogist will contact the Client in the rare occasion that the timescale must be extended.

Disclaimer

The Client understands that it is possible that certain pedigree lines cannot be extended due to a range of issues such as illegitimacy (where a parent of a child may be unknown), documents not surviving, false or contradictory information in documents, ancestors moving out of the UK, etc.  If any of these issues become apparent within the first hour of research and before any documents have been purchased, the Client will be contacted and fully refunded.  If any of these issues become apparent after a more lengthy research, the Client will be contacted and either:

(a) The Client will be refunded in part

 OR

(b) The Client and the Genealogist agree to pursue other areas of the Client’s family history.

Term of Agreement

The term of this Agreement (the “Term”) will begin on the date that a 50% deposit of the total cost of the agreed service is sent by the Client to the Genealogist and thereafter cleared in the bank. The Term will remain in full force and effect until the completion of the Services subject to earlier termination as provided in this Agreement. The Term of this Agreement may be extended with the written consent of both the Genealogist and Client.

In the event that either Party wishes to terminate this Agreement prior to the completion of the Services, that Party will be required to provide one day’s written notice to the other Party.

Currency

Except as otherwise provided in this Agreement, all monetary amounts referred to in this Agreement are in Great British Pounds (GBP).   Conversion to other currencies is applied according to the exchange rate on the date of agreement of both Parties.

​

Payment and Expenses

All payments and expenses must be pre-approved by the Client before Research commences.

​

A deposit of 50% of the total cost of the Service will be payable by the Client and cleared through the bank before Research commences. For the remaining amount, the Client will be invoiced when the Services are complete.

​

Payment of an invoice submitted to the Client is due within 30 days of request.

​

The Standard Research Package Fees cover the Genealogist’s Research Time plus Expenses incurred by the Genealogist.

​

In the quotation of costs for bespoke services, the Genealogist charges for Research Time plus Expenses.

​

The cost of tailored  research undertaken by the Genealogist generally starts from £35 per hour, or as stated at such times when Special Offers apply. Travel time will not be charged to the Client but travel costs will be incurred at the rate of 20p per mile by car (January 2019)

​

Costs of overnight stay, where applicable, will not exceed £100. 

​

The fees for acquisition of certificates, documents, photographs together with any printing and photocopying will be applied at Cost Price.

​

In the event that this Agreement is terminated by the Client prior to the completion of the Services, but where the Services have been partially completed, the Genealogist will be entitled to pro rata of the total cost of Services to the date of termination, provided there has been no breach of contract on the part of the Genealogist.

​

The Payment, as stated in this agreement, does not include Value-Added Tax.

​

Penalties for Late Payments

Any late payments will trigger a fee of 5% per working week on the amount still owing.

​

Privacy Policy and Confidentiality

The Genealogist collects personal information from the Client for genealogical purposes such as:

The names of client and names of his or her direct and indirect pedigree lines such as parents grandparents, uncles, aunts, etc. together with details of their births, marriages, divorce, and deaths, which would normally include their addresses and family relationships at the time of such events.

 

Such information assists the Genealogist to more clearly and uniquely identify the Client’s family and to start Research and extend the Client’s family tree further back in time and in line with the Terms and Conditions. Other personal information may also be collected from the Client and collated in the course of the Research project from historical sources or documentation.

 

The Genealogist also holds information such as Client names, together with their email addresses, telephone numbers, and addresses as contact details to answer the Client’s queries, provide quotes for types of Services, discuss research options, deliver updated family trees, research reports and historical documentation. Other purposes of holding such data include invoicing clients, maintaining financial accounts as a business for tax assessment purposes, and liaising with printing companies if research results are to be presented as gifts.

 

Client Information will be stored on a computer secured with a password.

Confidentiality

Confidential information (the “Confidential Information”) refers to any data or information relating to the Client, whether business or personal, which would reasonably be considered to be private or proprietary to the Client and that is not generally known and where the release of that Confidential Information could reasonably be expected to cause harm to the Client.

The Genealogist agrees not to disclose, divulge, reveal, report or use, for any purpose, any Confidential Information which the Researcher has obtained, except as authorised by the Client or as required by law. The obligations of confidentiality will apply during the term of this Agreement and will survive indefinitely upon termination of this Agreement.

All written and oral information and material disclosed or provided by the Client to the Genealogist under this Agreement is Confidential Information regardless of whether it was provided before or after the commencement of this Agreement or how it was provided to the Genealogist.

Client Rights and other Legal Obligations

 

The Client has the right to request the Genealogist access to a copy of personal information held and to ask for information to be deleted.

 

Client data will only be stored for as long as is necessary to fulfil any service contractual agreement and to adhere with legal obligations relating to maintaining adequate accounting records.

 

The Genealogist may use and disclose Client information in order to comply with any court order or request from a law enforcement or government agency.

Ownership of Intellectual Property

All intellectual property and related material (the “Intellectual Property”) that is developed or produced under this Agreement will be the property of the Genealogist.

​

Title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with the Genealogist.

​

The Client is the owner of the Report purchased by the Client from the Genealogist. The Client must obtain the Genealogist’s express written permission to publish any part of the Report in any format, printed or electronic.

​

The Client may make a small number of personal but not multiple copies of the copyrighted Report without written permission. The Client further agrees that if limited distribution is made of any aspect of the Genealogist’s research, the Client will report it accurately and credit the source.  The Client should be aware that copies of any documents or other material supplied with the Report may be subject to third-party copyright and should not be reproduced or sold on in any way without the written permission of the copyright holder.

​

Return of Property

Upon expiry or termination of this Agreement, the Researcher will return to the Client any property, documentation, records, or Confidential Information which is the property of the Client.

​

Modification of Agreement

Any amendment or modification of this Agreement or additional obligation assumed by either Party in connection with this Agreement will only be binding if evidenced in writing, signed by each Party, or authorised representative of each Party.
